By accessing or using SwimPass you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Description of Service

SwimPass provides real-time swimming conditions, spot discovery, personalized recommendations, and community features for open water swimmers. Conditions data is sourced from third-party weather and marine APIs and may not always be accurate.

3. Safety Disclaimer

SwimPass is an informational tool, not a safety guarantee. Always exercise your own judgment when swimming in open water. Conditions can change rapidly. Never rely solely on SwimPass data for safety decisions. SwimPass is not responsible for injuries, accidents, or losses that occur while swimming.

4. User Accounts

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating an account. We reserve the right to suspend accounts that violate these terms.

5. User Content

You retain ownership of content you submit (condition reports, reviews, photos). By submitting content you grant SwimPass a non-exclusive license to display and distribute it within the platform.

6. Prohibited Use

You may not use SwimPass to scrape data at scale, impersonate others, submit false condition reports, or interfere with the service. Commercial use of our data requires written permission.

7. Subscription & Billing

Premium features require a paid subscription. Subscriptions renew automatically unless cancelled. Refunds are handled according to the policies of the app store or payment provider through which you subscribed.

8. Limitation of Liability

SwimPass is provided “as is” without warranties of any kind. To the maximum extent permitted by law, SwimPass shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.

9. Changes to Terms

We may update these terms from time to time. Continued use of SwimPass after changes constitutes acceptance of the updated terms.
